1. ACCESS AND TERMS OF USE OF THE WEBSITE

The Website has a section that may be visited and accessed without providing personal data; in this case, its use is purely informational. It also has another section where the user must provide personal data for the proper management and purchase of the available tourism packages. During this online purchase process, basic identification data will be requested, as well as the data necessary for payment via PayPal, MasterCard and VISA.

By accessing any part of this Website, you accept the General Terms of Use of the Website. If you do not accept the terms and conditions of this Website, you must leave it immediately and you will not be able to place orders through it (as provided for in European Regulation 679/2016 on data protection policy).

The availability and quality of Internet access may vary depending on factors such as available bandwidth, the type of device used or the User’s geographical location. These factors do not depend on MY TOP TOUR (MNPQ GESTORES TURÍSTICOS, S.L.), and it shall not be liable for any aspect related to the User’s Internet access service.

2. LEGAL STATUS

By submitting a message via the Website contact form, you warrant that you have the necessary legal capacity to enter into binding contracts.

3. LIMITATION OF LIABILITY

A. User liability.
Any use made by the user of mytoptour.es shall be the sole and exclusive responsibility of the user, and MNPQ GESTORES TURÍSTICOS, S.L. shall be released from any loss or damage that, directly or indirectly, may be caused to the user or to third parties as a result of the user’s failure to comply with these Terms of Use.

B. Liability of tour providers.
They shall be responsible for the preparation and updating of their offers, tourism services, and the data derived from them, and MNPQ GESTORES TURÍSTICOS, S.L. shall not be responsible for the maintenance, updating or supervision of such information.

C. Disclaimer of liability.
MNPQ GESTORES TURÍSTICOS, S.L. shall not be liable, either directly or indirectly, for the following:

The quality of the service, the proper functioning, or the availability and continuity of the website, as well as any liability arising from other providers unrelated to MNPQ GESTORES TURÍSTICOS, S.L.
Information and data entered by third parties other than the staff of MNPQ GESTORES TURÍSTICOS, S.L.
Damage that may be caused to users’ equipment as a result of using the website.
If, in cases of force majeure, deficiencies arise in bookings, booking confirmations, or in the performance of the services or products contracted through the website, provided that such deficiencies were not foreseeable or could not be resolved by the Agency, unless they were a consequence of negligence attributable to MNPQ GESTORES TURÍSTICOS, S.L.
Infringement of intellectual and industrial property rights, the right to honour, personal and family privacy, and the image of individuals belonging to a third party, as a result of the transmission, dissemination, storage or provision of access to the contents of the website.
Typos, inaccuracies or errors of any kind; therefore, MNPQ GESTORES TURÍSTICOS, S.L. does not guarantee the accuracy or reliability of the information contained on the website.

4. CONTRACTING

Once the User selects a tourism Service and/or Product on the website, they will be redirected to a calendar where they may select the date on which the chosen service and/or product will take place. The User may then choose the time slot, subject to availability shown on the Website, as well as the number of people, distinguishing between adults, students and children of different ages.

Bookings are subject to acceptance by My Top Tour, to the availability of the contracted tourism Service and/or Product, and to the User’s compliance with and acceptance of these General Terms and the Usage Policies.

To complete the booking, the User must fill in a form requesting their first and last name, as well as an email address to which the booking voucher (hereinafter, the “Voucher”) will be sent. Optionally, they may also provide a telephone number and any comments or observations.

Once the form has been completed and these General Terms and Usage Policies have been accepted, the User will be directed to the payment gateway (hereinafter, the “Gateway”).

At the Gateway, the User will choose their preferred payment method and the corresponding verification and authentication will be carried out. Finally, the User will automatically receive a booking confirmation at the email address provided. Receipt of this confirmation concludes the binding contract (hereinafter, the “Contract”).

My Top Tour reserves the right not to accept a booking if payment information is not approved or if any other issue is detected in relation to the General Terms. When you carry out a transaction through our Website, we will send you a confirmation email with the transaction details. My Top Tour recommends that the User verify that the details shown in the confirmation message are correct and keep a copy for their records.

For those contracted tourism Services and/or Products for which there is no availability on the date or time chosen by the User, My Top Tour will take the appropriate steps so that the User may carry it out on another date or within another time slot.

Exceptionally, some bookings of tourism Services and/or Products contracted through the My Top Tour Website are not made through the booking calendar, but instead require a request for availability via a contact form. Once the request has been submitted, My Top Tour will contact the User directly using the data provided in order to confirm availability.

5. WITHDRAWAL PROTOCOL (REFUNDS)

Failure to show up for a visit or arriving after the tour start time, as well as not bringing a national ID card or passport for visits that include tickets for the Alhambra or other monuments that require it, shall not entitle the customer to any refund of the amount paid for the purchased tours.

The cancellation policy is specified on each product page.

Likewise, in accordance with Law 3/2014 of 27 March, which amends the consolidated text of the General Law for the Defence of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007 of 16 November, Article 103 (regarding exceptions to the right of withdrawal) establishes that:

l) The provision of accommodation services for purposes other than serving as housing, transport of goods, vehicle rental, food, or services related to leisure activities, where the contracts provide for a specific date or period of performance.

Therefore, the right of withdrawal shall be excluded in accordance with the above and with the cancellation policy applicable to each product as indicated on the website. The customer shall bear the cost of the booking in the event of withdrawal.

In the event of a pandemic or other force majeure circumstances beyond our control that prevent the tour from taking place, the amount paid will be made available to you through a voucher that can be used for any of our products, valid for 2 years, and not through a refund of the amount paid.

6. CUSTOMER SERVICE

6.1. Submission of complaints and claims

Customers may submit any complaints they deem appropriate either by post or electronically. The postal address for sending complaints is: Edificio Spring Glory, C. If the customer prefers to submit their complaint online or electronically, they must send it to the following email address: legal@mytoptour.es. 7. WEBSITE USE LICENCE

You may use this website and print and download extracts from it for your personal, non-commercial use, provided that you comply with the following rules:

7.1. You may not make fraudulent use of the Website (such as hacking or “scraping”).

Unless otherwise stated, copyright and other intellectual and industrial property rights in this Website and in the content published on it (including but not limited to photographs and graphic images) are owned by MNPQ GESTORES TURÍSTICOS, S.L. These works are protected by intellectual property and copyright laws and treaties worldwide, and all rights are reserved.

7.3. You may not modify paper or digital copies of any content you print, and you may not use any drawings, photographs or any other graphics, video or audio sequences separately from any accompanying text.

8. PROMOTIONS AND DISCOUNTS

Discount codes* offered by MY TOP TOUR allow users to access special promotions on certain products or services available on our platform. The application of such codes is subject to the specific conditions of each campaign, including possible limitations by dates, products, territories or maximum number of uses.

For a discount code to be valid, it must be entered correctly during the purchase process, before order confirmation and payment. Discount codes cannot be applied retroactively, nor can different codes be combined in the same purchase, unless expressly stated otherwise.

Each code may be subject to specific limitations such as an expiry date, a limited number of uses, or geographic restrictions. If misuse, fraud or breach of the established conditions is detected, MY TOP TOUR reserves the right to cancel or invalidate the code and/or the affected order.

MY TOP TOUR may also request additional information or documentation to verify the user’s identity or to prevent fraud related to the use of discount codes.

Finally, MY TOP TOUR reserves the right to modify, suspend or cancel any discount code or promotion without prior notice when technical, legal or commercial reasons so justify.

*Currently, we have the VERANOTOP coupon active, which will be valid until 30 September.

*VELADA15 CODE TERMS AND CONDITIONS: The promotional code will be valid only for bookings made on 26 and 30 July, and exclusively for the first 100 confirmed bookings that apply it correctly during the purchase process. The promotion cannot be combined with other discounts, codes or offers in force, and will apply only to selected products. Once the usage limit is reached, the code will be automatically deactivated without prior notice. If the discount is not applied due to a technical error, the customer must report it before completing the purchase, as it cannot be applied retroactively. MY TOP TOUR reserves the right to cancel the use of the code if misuse, fraud or conduct contrary to these terms is detected.
